3. How We Share Your Information

We do not sell your personal information to third parties. We share information only in the following circumstances:

3.1 Service Providers. We share information with third-party service providers who perform functions on our behalf, including:

  1. Malla — practice management, client communication, program delivery, and payment processing

  2. Website hosting and analytics providers — to maintain and analyze website performance

These providers are authorized to use your information only as necessary to provide services to us and are required to protect your information.

3.3 Business Transfer. If Fusion Wellness is acquired, merged, or transfers substantially all of its assets, your information may be transferred as part of that transaction. We will notify you of any such change by updating this Privacy Policy.

3.4 With Your Consent. We may share your information with third parties when you give us explicit consent to do so.

3.5 Anonymized Information. We may share anonymized, de-identified, or aggregated information that cannot reasonably be used to identify you for educational content, case studies, marketing, or research purposes. This is consistent with the Anonymized Use provision in our Client Services Agreement.

4. Health Information — Special Provisions

Because Fusion Wellness operates as a wellness coaching practice, we want to be clear about how health information is handled.

4.1 Voluntary Sharing. All health information — including blood panel results, lab reports, and personal health details — is shared by you voluntarily. We do not request or access your medical records from any health care provider, hospital, lab, or insurer. You choose what to share with us.

4.2 Purpose Limitation. Health information you share is used solely for the purpose of providing wellness coaching and education under your Client Services Agreement. We do not use your health information for marketing, advertising, or any purpose unrelated to your coaching services without your separate written consent.

4.3 Not a HIPAA-Covered Entity. Fusion Wellness is a wellness coaching practice and is not a HIPAA-covered entity. The privacy protections for your health information described in this Policy and in the Client Services Agreement are contractual obligations. They are not HIPAA protections. If you require HIPAA-level protections, please discuss this with us before sharing health information.

4.4 Blood Panel Results. Blood panel results are delivered by the laboratory (such as Quest Diagnostics or LabCorp) directly to you. We do not receive results from the laboratory. You share your results with us voluntarily through the Malla platform or other communication channels for the purpose of receiving coaching services.

4.5 Confidentiality. We treat all health information as confidential and do not disclose it to any third party without your written consent, except as required by law or as described in Section 3 of this Policy.

5. Data Security

We take reasonable administrative, technical, and physical measures to protect your information from unauthorized access, use, alteration, and disclosure. These measures include:

  1. Use of the Malla platform, which maintains its own security standards and is HIPAA-compliant

  2. Encryption of data in transit (HTTPS/SSL on our website)

  3. Access controls limiting who can view your information within our practice

  4. Secure password practices and authentication

No method of transmission over the Internet or electronic storage is completely secure. While we strive to protect your information, we cannot guarantee absolute security. If you believe your information has been compromised, contact us immediately at the email address provided below.

6. Cookies and Tracking Technologies

6.1 What Are Cookies. Cookies are small text files placed on your device when you visit a website. They help the website remember your preferences and understand how you use the site.

For analytics and marketing cookies, you may also opt out through the specific provider’s opt-out tools.

6.4 Do Not Track. Some browsers send a “Do Not Track” signal. There is no industry standard for responding to these signals. Our website does not currently respond to Do Not Track signals.

8. Data Retention

8.1 General Retention. We retain your personal information for as long as necessary to fulfill the purposes described in this Policy, including to provide services, comply with legal obligations, resolve disputes, and enforce our agreements.

8.2 Client Information. If you are or were a coaching client, we retain your program records, communications, and health information shared during the coaching relationship for a period of seven (7) years after the coaching relationship ends, unless a longer period is required by law. This retention period allows for tax compliance, legal defense, and continuity if you return for additional coaching.

8.4 Deletion Requests. You may request deletion of your personal information as described in Section 9. Certain information may be retained as required by law or for legitimate business purposes (such as tax records or defense of legal claims) even after a deletion request.

9. Your Rights

9.1 All Users. Regardless of where you are located, you have the right to:

  1. Access. Request a copy of the personal information we hold about you

  2. Correction. Request that we correct inaccurate or incomplete personal information

  3. Opt Out of Marketing. Unsubscribe from marketing emails at any time using the link in any email or by contacting us

  4. Deletion. Request deletion of your personal information, subject to our retention obligations and legal requirements

To exercise any of these rights, contact us at the email address provided in Section 14.

9.2 Colorado Residents. The Colorado Privacy Act (CPA) provides certain rights to Colorado residents when the statutory thresholds are met. Fusion Wellness LLC currently processes personal data from significantly fewer than 100,000 Colorado residents annually and does not sell personal data. As a result, the CPA’s formal compliance requirements (such as data protection assessments and universal opt-out mechanisms) do not currently apply to Fusion Wellness LLC. If our data processing volume reaches the statutory thresholds, we will update this Policy to reflect the additional rights and obligations.

Regardless of whether the CPA formally applies, we honor access, correction, and deletion requests from Colorado residents as described in Section 9.1.

9.3 European Union, United Kingdom, and EEA Residents. If you are located in the European Union, United Kingdom, or European Economic Area, the General Data Protection Regulation (GDPR) or UK GDPR may apply to our processing of your personal data. In addition to the rights in Section 9.1, you have the right to:

  1. Restriction. Request that we restrict the processing of your personal data in certain circumstances

  2. Portability. Request a copy of your personal data in a structured, commonly used, machine-readable format

  3. Object. Object to certain processing of your personal data, including processing for direct marketing

  4. Withdraw Consent. Where processing is based on your consent, withdraw that consent at any time without affecting the lawfulness of processing prior to withdrawal

  5. Lodge a Complaint. Lodge a complaint with a supervisory authority in your country of residence if you believe your data protection rights have been violated

Legal Basis for Processing. For EU/UK/EEA users, we process personal data on the following legal bases:

  1. Contract. Processing necessary to perform our Client Services Agreement with you

  2. Consent. Processing based on your voluntary and informed consent (e.g., sharing health information, subscribing to newsletters)

  3. Legitimate Interests. Processing necessary for our legitimate business interests (e.g., website analytics, fraud prevention), where those interests are not overridden by your data protection rights

International Data Transfers. Fusion Wellness is based in the United States. If you are located outside the United States, your personal data will be transferred to and processed in the United States. By using our website or services, you consent to this transfer. For EU/UK/EEA users, we rely on your explicit consent as the legal basis for this transfer.

9.4 California Residents. The California Consumer Privacy Act (CCPA) provides certain rights to California residents when the statutory thresholds are met. Fusion Wellness does not meet the CCPA’s revenue or data processing thresholds. We do not sell personal information. Regardless, we honor access, correction, and deletion requests from California residents as described in Section 9.1.

10. Children’s Privacy

Our website and services are not directed to individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will delete that information promptly. If you believe a child has provided us with personal information, please contact us at the email address below.

11. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, services, legal requirements, or for other operational reasons. When we make material changes, we will update the “Last Updated” date at the top of this Policy and, where appropriate, provide notice through our website or by email.
