1. Agreement to Terms
1.1 Acceptance. By accessing or using the website www.fusionwellness.life (the “Website”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, do not use the Website.
1.2 Who We Are. The Website is owned and operated by Fusion Wellness LLC, a Wyoming limited liability company. Robert D. Mordini, Jr. is the principal of Fusion Wellness LLC and operates from Denver, Colorado. References to “we,” “us,” or “our” mean Fusion Wellness LLC.
1.3 Changes to Terms. We may update these Terms at any time by posting the revised version on the Website with a new “Last Updated” date. Your continued use of the Website after any changes constitutes your acceptance of the updated Terms.
2. Nature of Website Content
2.1 Educational and Informational Only. All content on the Website — including blog posts, articles, program descriptions, product information, educational materials, videos, and social media content linked from the Website — is provided for educational and informational purposes only. Nothing on the Website constitutes medical advice, medical diagnosis, medical treatment, or any form of licensed health care.
2.2 Not a Substitute for Medical Care. The content on the Website is not a substitute for professional medical advice, diagnosis, or treatment from a licensed health care provider. Always consult a qualified, licensed physician or health care provider before making changes to your health, diet, supplement regimen, exercise, or lifestyle. Never disregard professional medical advice or delay seeking medical treatment because of something you read on the Website.
2.3 Credential Disclosure. Robert D. Mordini, Jr. is a functional wellness coach and the published author of Environmental Inflammation. He is currently a PhD candidate in Functional Medicine and Natural Medicine at Rockwell University. He has not yet completed his doctoral degree. He is not a licensed medical doctor, physician, or licensed health care provider of any kind.
2.4 No Professional Relationship. Browsing the Website, reading its content, or contacting Fusion Wellness LLC through the Website does not create a coaching relationship, a professional relationship, a doctor-patient relationship, or any other client relationship. A coaching relationship is established only by signing a Client Services Agreement.
3. Wellness Disclaimers
3.1 Supplement and Product Information. The Website may contain information about supplements, wellness products, and health-related products. This information is educational and is provided to support general body system function and optimal health. It is not a prescription, and it is not intended for the treatment, cure, prevention, or management of any disease or medical condition.
3.2 Lab and Biomarker Information. The Website may contain educational content about lab results, biomarkers, and health factors. This content is educational and is not a medical interpretation or diagnosis. Your licensed health care provider is responsible for the clinical interpretation of your lab results.
3.3 Results Not Guaranteed. Individual wellness outcomes vary based on numerous factors. Nothing on the Website guarantees any specific health outcome, result, or improvement.
3.4 FDA Disclaimer. Any statements on the Website regarding dietary supplements or wellness products have not been evaluated by the Food and Drug Administration. Products discussed or linked on the Website are not intended to diagnose, treat, cure, or prevent any disease.
4. Affiliate Links and Financial Disclosures
4.1 Affiliate Relationships. The Website may contain affiliate links to third-party products and services. If you purchase through an affiliate link, Fusion Wellness LLC may receive a commission at no additional cost to you.
4.2 Own Products. Fusion Wellness LLC may sell its own products, programs, and services through the Website. When Fusion Wellness LLC has a financial interest in a product or service discussed on the Website, that relationship will be disclosed.
4.3 Third-Party Products. Fusion Wellness LLC does not manufacture, control, or guarantee the quality, safety, or effectiveness of any third-party product linked from the Website. Your purchase and use of third-party products is at your own risk and subject to that third party’s terms and policies.
5. Intellectual Property
5.1 Ownership. All content on the Website — including text, graphics, images, logos, blog posts, articles, educational materials, program descriptions, videos, audio, and design elements — is the intellectual property of Fusion Wellness LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.
5.2 Limited License. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its content for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, sell, or otherwise exploit any content from the Website without the prior written consent of Fusion Wellness LLC.
5.3 Book and Published Works. Environmental Inflammation and any other published works by Robert D. Mordini, Jr. referenced on the Website are protected by copyright. Excerpts, summaries, or references on the Website do not grant any license to reproduce or distribute those works.
5.4 Trademarks. “Fusion Wellness,” “Fusion Wellness LLC,” and any associated logos or branding on the Website are trademarks or trade names of Fusion Wellness LLC. You may not use them without prior written consent.
6. User Conduct
6.1 Acceptable Use. You agree to use the Website only for lawful purposes and in accordance with these Terms. You agree not to:

6.2 User-Submitted Content. You represent that you own or have the right to submit any content you provide.
7. Third-Party Links and Services
7.1 External Links. The Website may contain links to third-party websites, products, and services, including but not limited to the Malla platform, Quest Diagnostics, LabCorp, Amazon, and affiliate partner sites. These links are provided for convenience only. Fusion Wellness LLC does not control, endorse, or assume responsibility for any third-party website or service.
7.2 Third-Party Terms. Your use of any third-party website or service is subject to that third party’s own terms of use and privacy policy. Fusion Wellness LLC is not a party to any transaction between you and a third party.
8. Privacy
8.1 Privacy Practices. Your use of the Website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Website, you consent to the practices described in the Privacy Policy.
8.2 Not a HIPAA-Covered Entity. Fusion Wellness LLC is a wellness coaching practice and is not a HIPAA-covered entity. Information submitted through the Website is not protected by HIPAA.
9. Limitation of Liability
9.1 As-Is Basis. The Website and all content are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Fusion Wellness LLC does not warrant that the Website will be uninterrupted, error-free, or free of harmful components.
9.2 Limitation. To the maximum extent permitted by law, Fusion Wellness LLC, its owner, agents, and contractors shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of or inability to use the Website or its content, including but not limited to damages for health outcomes, personal injury, emotional distress, lost data, or lost profits, whether based in contract, tort, strict liability, or any other legal theory, even if Fusion Wellness LLC has been advised of the possibility of such damages.
9.3 Liability Cap. In any event, Fusion Wellness LLC’s total liability to you for all claims arising out of or related to the Website shall not exceed one hundred dollars ($100).
9.4 Essential Basis. You acknowledge that the limitations and exclusions in this Section reflect a reasonable allocation of risk and are an essential basis of the bargain between you and Fusion Wellness LLC.
10. Indemnification
You agree to indemnify, defend, and hold harmless Fusion Wellness LLC, its owner, agents, and contractors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Website, your violation of these Terms, or your violation of any rights of any third party.
11. Dispute Resolution
11.1 Governing Law. These Terms are governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws provisions.
11.2 Informal Resolution. Before filing any formal proceeding, you agree to attempt in good faith to resolve any dispute by sending written notice to Fusion Wellness LLC describing the dispute and proposing a resolution. Fusion Wellness LLC will attempt to resolve the dispute informally within thirty (30) days.
11.3 Binding Arbitration. If the dispute is not resolved informally, either party may submit it to binding arbitration in accordance with the rules of the American Arbitration Association, conducted remotely via video conference. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction. Each party shall bear its own attorneys’ fees unless the arbitrator determines otherwise.
11.4 Class Action Waiver. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not as a class action, class arbitration, or other representative proceeding. You waive any right to participate in a class action against Fusion Wellness LLC.
11.5 Exceptions. Nothing in this Section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.
12. Colorado Disclosure
Required by Colorado Revised Statutes Section 6-1-724 (Colorado Natural Health Consumer Protection Act):
Robert D. Mordini, Jr. is a functional wellness coach operating from Denver, Colorado and is not licensed, certified, or registered by the State of Colorado as a health care professional. The services provided by Fusion Wellness LLC are complementary and alternative health care services delivered via telehealth. These services are not a substitute for medical care from a licensed physician. It is recommended that you maintain a relationship with a licensed primary care physician for your ongoing medical needs.
13. General Provisions
13.1 Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Fusion Wellness LLC regarding your use of the Website. They do not govern the coaching relationship, which is governed by a separate Client Services Agreement.
13.2 Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
13.3 Waiver. The failure of Fusion Wellness LLC to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
13.4 Assignment. You may not assign or transfer any rights under these Terms without the prior written consent of Fusion Wellness LLC. Fusion Wellness LLC may assign these Terms to a successor entity without your consent.
